I. GENERAL TERMS AND CONDITIONS

A. Scope

  1. These Terms and Conditions govern the use of the website "GameTwist" as well as the contents and services provided therein. They also apply to all contents that users communicate or send on the "GameTwist" site in the form of e-mails, SMS, forum contributions and chat messages, or post on the site, e.g. picture uploads (hereinafter referred to as ‘user content’), as well as the acquisition of prizes, virtual goods and virtual currencies.
  2. The user confirms knowledge and acceptance of the General Terms and Conditions when registering by clicking "I accept the General Terms and Conditions of 'GameTwist'", followed by the "Next" button.

B. Place of conclusion of contract

  1. All legal relationships between the operator and the user are governed by Austrian law with the exclusion of its conflict of law rules. The place of fulfilment is Vienna. Any dispute shall be settled by the court having jurisdiction for the 1st district of Vienna.

C. Company Purpose

  1. The operator offers a gaming platform on the website http://www.gametwist.co.uk (hereinafter referred to as the ‘website’ or ‘GameTwist’). Players may take part in games using a Guest Account, a free Standard Account, which can be upgraded to a Gold Subscription Account via different subscription models, as well as an account for the browser games offered on the website.
  2. The operator may tie access to particular games and services to specific conditions (such as a particular account and subscription type) which are communicated on the website on a case to case basis.
  3. The operator reserves the right to extend or change the service offer on a continual basis. The amendments, improvements, expansions and changes will be published in the news section of the website.

D. Conditions of Participation

  1. The right to participate in the games and use the services provided on the website exists only within the cope of the current state of technology.
  2. The technical configuration of the user’s device is the sole responsibility of the user. Details for recommended configuration can be found in the Help and FAQ sections of the website. The operator offers the user e-mail support free of charge and a support hotline subject to a fee. There is no guarantee for the continuous availability of the hotline or that e-mails will be answered within a particular period. The tariffs for the hotline can be found on the website.
  3. Any additional benefits beyond the aforesaid offered free of charge do not become part of the owed service and may be discontinued by the operator at any time.

E. Registration

  1. Guest Account:
    1. A Guest Account allows users limited use of the standard games on the GameTwist site for testing without registering a nickname of their own. Participation in the browser games and the use of communication services on the GameTwist site are not possible with a Guest Account.
    2. Access is limited to test games in the beginner rooms of the standard games.
  2. Standard Account:
    1. Users may open a so-called Standard Account by properly completing the registration process.
    2. Only one standard account per natural person may be opened. The registration of a Standard Account is free of charge and allows the user access to standard games and the following features:
      • access to the standard games and limited access to the beginner lobbies of the Gold Subscription games
      • creation of a personal player profile
      • use of the GameTwist Friends List
      • use of the GameTwist messaging system
      • use of the GameTwist challenge system
      • acquisition of bonus points ("Twists")

Apart from that, participation in the browser games is possible after having taken note of and accepted the extended Terms and Conditions.

    1. A Standard Account can be upgraded to a Gold Subscription Account by signing up for a Gold Subscription subject to a fee (see Point V).
  1. Browser Games Account
    1. Correct completion of the registration process in one of the offered browser games will automatically create a Standard Account, which also allows the user access to the GameTwist standard games with the same access data.
    2. Only one account per natural person may be opened. The registration of a browser games account is free and allows the user access to browser games.
  2. Registration for a Standard or Browser Game Account
    1. 4.1 The registration must include the following details which must be stated correctly and completely without providing any misleading information:
      1. Personal and confidential pseudonym (“user name”, “nick”). The user is not entitled to any specific nick.
        The username must be clear and unmistakable. Offensive, immoral and objectionable names are forbidden. Names that contain or obviously suggest internet links, and account names suggesting certain extended rights of the user (in particular the designation of ‘administrator’ or any similar designation) are also forbidden. The operator reserves the right to prohibit any unacceptable user name and to block unacceptably named accounts. The account will be unblocked once the user has changed the username to a permitted “nick”.
      2. Password. The user is not entitled to any specific password.
      3. E-mail Address
    2. The use of the features of the standard and browser games accounts is possible by means of the activation link sent by e-mail together with the acknowledgement of registration. Until it is activated the account will remain a Guest Account.
    3. The contract between the user and the operator on the use of the services offered on the GameTwist website is concluded upon proper completion of the registration process.
    4. Should any information provided by the user prove to be false, the operator is entitled to totally or partially bar the offending user (even indefinitely) from using the services, and may refuse to deliver/pay out any prizes the user may have won.
    5. The user undertakes to keep his/her personal data up-to-date at any time, and to correct the user data on the website forthwith by following the link “Change Data” in the event of any changes of name, address, e-mail, etc.. The user is also responsible for protecting his/her access data against unauthorized third-party access. Any actions carried out via the account of the user or under the name of the user shall be attributed to the user.

F. Property Rights to Contents

  1. By registering an account and/or using the services provided by GameTwist, the user acknowledges that the entire content of the website is the sole and unrestricted property of GameTwist. The user undertakes to use the website, the services and any and all of the contents and information contained therein exclusively in the framework of the intended personal use, and to refrain from changing, copying, publishing, distributing or exploiting in any other way any of the aforesaid and further undertakes to refrain from interfering with the website, the services and any of the contents and information contained in it by technical means in any form whatsoever.
  2. Any user content transferred to GameTwist by the user (such as photos, questions, suggestions about games and organisational processes, etc.) shall become the sole and unrestricted property of the operator. The user shall not be entitled to any compensation. Transfer of user content of any kind, including the technical and tactical sequences of the games themselves, by the user constitutes a transfer of rights to the content.

G. Proper Conduct

  1. Improper conduct on GameTwist is prohibited. This includes in particular but is not limited to
    • braking the rules regarding communication between users
    • deliberately submitting false or misleading information
    • any attempt to influence the result of a game by collusion, tampering with the programme or by any other means contrary to the rules
    • causing malfunctions or failure deliberately in order to influence the course of a game
    • creating several gaming accounts for one person
    • braking any other rules set forth in the General Terms and Conditions.
  2. The user shall
    1. not make any attempt to decompile or reproduce the gaming software used on the GameTwist website, shall not interfere with it in any other way, and shall not develop any software that interferes with the gaming software used on GameTwist and client-server communication;
    2. not use any software permitting the use of artificial intelligence or allowing opponent profiling or user collusion;
    3. not use any software which in the operator’s sole discretion is regarded as a programme allowing a user to cheat or giving a user an unjust advantage over another player;
    4. use the games and services exclusively with an Internet browser;
    5. refrain from using any scripts, which are not authorised by the operator;
    6. not use any software, which allows the user to analyse or reproduce the website or individual games, or allows the user to interfere with the website and the games and/or their programming in any other way;
    7. not use any programme causing an excessive burden on the server.
  3. The operator reserves the right to take the necessary steps if required to detect and prevent the use of such software by users, including but not limited to identifying and detecting the programmes installed on a user’s computer, or profiling a player’s behaviour for reasons of investigation. Should the operator detect, or suspect with good reason the use of such prohibited software, it shall be entitled to freeze the relevant player’s account for a period of at least six (6) months, to withhold any funds in that account and/or to suspend the player from using the operator’s website and any other services of the operator or its associated companies.

H. Communication and other Conduct between Players

The user assumes liability that any user content generated by him/her does not violate any legal provisions or third party rights. Specifically, the user undertakes to respect the privacy of other users, and to refrain from any racist, xenophobic, discriminatory, pornographic, or sexually degrading statements and from placing any such contents, as well as from any kind of threats or harassing behaviour.

The following is also prohibited:

  • the distribution of advertising
  • conducting surveys
  • the distribution of chain letters
  • spying out the personal data of other users without their explicit consent
  • spreading viruses, worms, etc. and any other activity affecting other computer systems and programmes
  • messages that serve the exclusive purpose of spreading religious, political and ideological convictions
  • bothering other users by entering senseless combinations of characters
  • deliberately blocking games and communication processes in any way.

I. Sanctions for Improper Conduct

The operator reserves the right to instantly terminate the contract of any users who conduct themselves contrary to the rules stated in these General Terms and Conditions. The operator also has the right to terminate any running games, block an account or ban a user with or without prior notice, delete any credit and/or withhold prizes.

J. Cancellation

  1. Both contract parties may terminate the contract with immediate effect at any time and without stating reason. The user must send an e-mail with his/her name and account name to support@gametwist.com. The deletion of the account will be carried out once security questions have been correctly answered. In terminating the contract the user loses all claims to his/her account and to any services, virtually goods and virtual currencies associated with it.
  2. Should an account not be logged into over a period of 6 months, it will be deleted for lack of activity. Before the deletion is carried out, however, at least two notification e-mails will be sent to the account holder using the e-mail address given in the account data.

K. Bonus Points ("Twists")

  1. Users are awarded bonus points called ‘Twists’ for undertaking certain actions. Twists can only be acquired and used as stakes in the standard games on the website.
  2. Guest players do not receive bonus points.
  3. Bonus points are awarded according to a system, which is explained in detail in the section “Bonus Points” in the help section of the website. The operator reserves the right to make changes to the system at any time. Any changes made will be announced in the news section.

Prize Games and Tournaments

  1. GameTwist Tournaments / Provider Tournaments
    1. Prize games and tournaments that take place on GameTwist may be subject to participation limitations if this is explicitly announced on the website. There is no entitlement to participate.
    2. If a prize is on offer for a certain tournament, this shall be announced on the website in advance (including any specific conditions of delivery). The operator reserves the right to change the prizes without prior notice.
    3. A user is deemed a winner of a tournament when the operator officially announces him/her as the winner once the tournament has finished. In this context no liability is accepted for any errors. The user is informed by the operator via e-mail, also of any possible winnings. The operator is entitled to cancel any winning announced erroneously in violation of the game conditions without giving a reason. Any recourse to the courts shall be excluded.
    4. Within four weeks of receiving the notification of winning, the winner must inform the operator in writing whether he/she wants to accept the prize. On this occasion the user must confirm his/her home address for delivery of the prize.
    5. Prizes in kind cannot be taken back or redeemed for cash. Prizes shall be sent to the home address communicated by the winner upon registration and confirmed in the course of the winning notification within eight weeks after having received the information from the winner.
    6. Prizes may only be delivered to users who have their permanent residence in Europe at the time of registering at GameTwist. Employees of the operator and sponsors and their family members are forbidden from taking part in prize games and tournaments.
    7. Should receiving gifts as a result of gaming activities be wholly or partially forbidden by law in a certain country, any prize won by a user whose permanent residence is in this country cannot be granted.
  2. User tournaments
    1. As a Gold Subscriber, a user may organise private tournaments.
    2. Gold Subscription users who are in the Friends List of the organiser having special access authorisation for the specific game may participate in the user tournaments.
    3. Each user may organise a maximum of one tournament per day.
    4. Organising real-prize tournaments (no matter whether for prizes in kind or in cash) is forbidden.

M. Mobile Games

  1. The operator offers selected games as downloads for a user’s mobile phone. The technical configuration of the mobile phones used is the sole responsibility of the user. Details about the mobile phone models supported can be found on the respective game pages.
  2. The mobile games are downloaded via an Internet connection to the mobile phone of the user. The connection tariffs may vary depending on the mobile or Internet service provider, however they will correspond to the usual tariffs for downloading.
  3. To download the mobile games the mobile phone model, the name of the mobile service provider and the mobile number must be given. If the user gives an incorrect model, provider or number, this can lead to an error or a delayed download. This is also the case if the mobile service provider does not support SMS/text messages, or when the user is beyond the coverage of the mobile service provider. The operator accepts no responsibility in any way for such delays or errors.
  4. If the user downloads a mobile game which is not supported by the mobile service provider, the operator is still entitled to charge for the game, even if the user’s mobile phone did not receive the game. This also applies if the user did not correctly configure his/her mobile phone for the use of WAP-Push and GPRS, or if an error detailed in point 3 arose.
  5. If the user restricts or changes his/her contract with the mobile service provider, this has no effect on the contract relationship and any associated additional services provided by the operator of the website.
  6. The user is obliged, as far as his/her mobile service provider allows, to check that the billing for the services of the operator is correct. If no written claim (by post, e-mail or fax) for this billing is made within 8 weeks of receipt of the mobile service bill or booking of the amount from a prepaid account of the user, the billing is deemed as accepted.
  7. The mobile game offer can be seen on the website. The operator reserves the right to change, reduce or expand the offer of mobile games at any time, as well change the price without giving reason. Furthermore the operator has the right not to offer certain games at its own discretion. In taking advantage of this right the operator has no responsibility in any way toward the user. The user has no claim to compensation if the mobile games he/she downloaded are no longer offered or are offered under different conditions.
  8. The mobile games are protected by the copyright and trademark rights of the operator. The user is allowed to save the mobile game on his/her mobile phone. Any other form of saving (e.g.: on a second mobile phone), copying, any other reproduction, processing or distribution of the game by the user is forbidden.

N. Virtual Goods

  1. In addition to the standard and subscription games the operator also offers browser games on the website, in the course of which virtual goods and virtual currencies can be acquired and used. The goods and currencies offered can vary depending on the type of browser game.
  2. The user has the opportunity to acquire the right of use of virtual goods on the website by paying in real money or using virtual currency. The acquisition of virtual goods or currencies grants the user solely the right to use them within the scope of and in accordance with the game; acquiring any further rights to the acquired goods or currencies (e.g. ownership) shall be excluded. The object of purchase is exclusively a licence which is limited in terms of time, content and location to the use of these goods or currencies within the scope of and in accordance with the respective game
  3. For each browser game the user can use a virtual currency, which is designated for that specific game.
  4. Irrespective of which terminology is used on the website or in the games, a user purchasing virtual goods or currencies only acquires a licence in accordance with these Terms and Conditions which is limited in terms of time, content, and location to the use of these virtual goods or currencies within the scope of and in accordance with the respective game. Any refund, redemption or compensation in real money is excluded. In case of violation of these Terms and Conditions the operator is entitled to revoke any one or all of the licences granted for the use of virtual goods or currencies. Upon termination of contract for any reason whatsoever, any and all licences granted for the use of virtual goods and currencies shall expire. Any virtual goods/currencies still available to the user upon termination shall be forfeited. The user shall not be entitled to any compensation.
  5. The user is forbidden from transferring his/her player account and any virtual goods and currencies held therein to any third party. The player account for use of the services provided on the website, any data on the operator’s servers and any user contents are the sole and unrestricted property of the operator.
  6. The virtual goods and currencies on offer can be found on the website. The operator reserves the right to change, reduce and/or increase the offer of virtual goods and currencies, and to adjust the prices of virtual goods and currencies at any time without giving a reason. Furthermore, the operator is entitled at its discretion to no longer offer virtual goods/currencies or to make them available free of charge or for a fee. In exercising this right, the operator has no obligation whatsoever towards the user. The user is not entitled to any compensation should the goods/currencies he/she uses be withdrawn or provided upon different conditions. This is valid for both temporarily and non-temporarily offered goods and currencies. Moreover the operator has the right to delete or change the player account and its associated player history and/or virtual goods and currencies at any time and without giving a reason. In this case the user is entitled to terminate the contract with immediate effect. Any further claim by the user is excluded.
  7. Payment for virtual goods and currencies can be made either as a one-off payment or in regular instalments over a defined period (month, year). Minors are obliged to make sure that their legal representative (parent or guardian) gives his/her consent and that sufficient funds are available to pay for the virtual goods and currencies.
  8. Payment of virtual goods/currencies with real money can be made using different payment methods found on the website. The operator reserves the right to change the payment methods available without giving a reason. The operator further reserves the right to set specific prerequisites for the use of certain payment methods. The operator does not warrant the uninterrupted availability of all payment methods.
  9. Virtual goods/currencies shall be considered paid for as soon as the account of the operator has been irrevocably credited with the corresponding amount. All account and/or monetary transactions are checked by the operator without assuming any liability. Any suspicious account and/or monetary transactions will be reported to the appropriate authority.
  10. The operator reserves the right at its own discretion to refuse the allocation of virtual goods/currencies or to set limitations on the number of goods/currencies or on the total amount. In case of suspicion of fraud, violation of laws or of these Terms and Conditions, the operator has the right to freeze acquisition processes and the related payment transactions until the situation has been clarified. Furthermore, the conditions set forth in Point 1 shall apply.
  11. The operator is entitled to publish all pictures and videos transferred in the game by the user (completely or any parts thereof) and report on them in any possible way mentioning the user’s nickname. This also applies to videos, pictures, etc. created by the user. When transferring or creating videos or pictures the user explicitly agrees to this reporting and irrevocably grants the operator all exclusive rights of use, exploitation, publication, editing and duplication for the mentioned reporting free of charge, without limitation as to the subject-matter, time and location. Any claim for compensation by the user shall be excluded.

II. DATA PROTECTION

  1. Upon registration, the user grants the operators the explicit consent to use the data provided during registration, as well as to save and process non-personal usage data. The operators agree to abide by the relevant legal data protection regulations in handling the user data. The data is processed automatically, and will not disclosed without the written consent of the user. In cases of malpractice/misuse the right is reserved to forward this data to the law enforcement authorities should legal necessity apply.
  2. The operator is entitled to save and analyse connection data, specifically source and destination IPs and all other log files in order to protect its own systems and those of third parties. The operator is also entitled to keep usage statistics, provided that they are not specific to any individuals. The user explicitly agrees to this when registering. Otherwise, data will be saved and analysed only as far as required for the performance of the services.
  3. The operator uses ‘cookies’ (small files that are saved on the hard disk of the user’s computer by the user’s browser when our website is visited) in order to adapt the website to the requirements of users and to allow GameTwist to be recognised when it is visited again. These cookies contain no personal data. The user agrees to the use of cookies by the operator.
  4. The operator employs all technically feasible measures to protect the user data saved by it, however it shall not be held liable should any third parties unlawfully gain possession of this data and use it. Any liability of the operator for any loss or damage suffered by the user or by any third party in any such context is excluded by mutual agreement.
  5. The user may view his/her saved personal data at any time by accessing his/her user settings.
  6. The user has the right to change or delete his/her data at any time. The operators undertake to actually delete any data that is requested to be deleted by the user. The deletion of compulsory data required for account registration automatically entails deleting the respective player account.

III. LIABILITY

  1. The operator does not warrant the uninterrupted availability or error-free functioning of the services offered, yet it will make reasonable efforts to correct any problems and/or errors. The operator and/or its vicarious agents shall be liable for damages beyond the scope of application of the Product Liability Act only if intention or gross negligence can be proven and only in the framework of the legal provisions. Any liability for slight negligence, compensation for consequential and financial losses, savings not achieved, loss of profits, lost data, losses of interest, and any liability for damages resulting from claims asserted by third parties against the user shall be excluded.
  2. The operator does not warrant and does not assume liability for the website or the games including the virtual goods/currencies offered therein being available 100 % without any downtime, does not warrant and does not assume liability that they do not contain any programming errors and/or that any and all errors detected are corrected completely. Furthermore, the operator assumes no liability for the website and the servers permitting access to the website being free from viruses or other damaging components which could lead to damage to the computer hard and software of the user. Any warranty or liability for specific characteristics of the virtual goods and currencies on offer within the scope of the games or for any effect on the course of the game in connection with them is excluded.
  3. The operator assumes no liability in connection with games or individual contests interrupted, finished prematurely or disrupted in any way whatsoever due to any technical problems, or the results of any such games.
  4. The operator assumes no liability for input, transfer and analysis errors, nor for the content, integrity and accuracy of conveyed or requested data. In particular, the operator reserves the right to retrospectively correct any obvious errors in the input and/or analysis of results (e.g. mistaking players, etc.), statements of stakes, prizes, quotas, etc.
  5. The operator assumes no liability for loss or damage of any kind arising through the improper use of the account by the user or a third party.
  6. The operator assumes no liability for any loss or damage due to circumstances beyond its control (e.g. acts of God, etc.).
  7. The operator assumes no liability for user content, however reserves the right to delete any content that infringes against the conditions of use or any legal provisions as soon as any such content becomes known, and to pass any such infringing content on to the appropriate law enforcement authority upon the instructions of a court or authority.
  8. In case of infringement against these General Terms and Conditions, the user shall indemnify and hold harmless the operator with respect to any resulting loss or third party claim, and shall reimburse the operator for any losses, costs or damage caused by any such infringement.

IV. OTHER TERMS

  1. The operator reserves the right to change or extend the service offer on a continual basis. The amendments, improvements, expansions and changes will be published in the news section of the website.
  2. The user explicitly accepts that the ranking lists may not reflect the actual capability of players, as almost every offered game involves an element of luck although this is subordinate. The operator ensures once again at this point that the generation of random numbers is based on an internationally renowned random generator, and is in no way manipulated by the operator. Further information about the random generator is available via e-mail from our support team.
  3. Revisions of the General Terms and Conditions will be sent to every user by e-mail or communicated on the games website. When the changes are communicated by email they shall be deemed accepted unless the user objects within two weeks. The user is informed of this consequence in the notification of changes. Any objection leads to automatic termination of the contract. The user is obliged to check the current Terms and Conditions on a regular basis.
  4. All messages and statements regarding this contractual relationship are valid only when communicated in writing or by e-mail.
  5. The user will promptly notify the operator of any changes of personal data by correcting the user data on the website. In the event that the user fails to inform the operator of any such changes and as a result does not receive any legally relevant declarations or statements of the operator sent to the mailing address or e-mail address previously communicated any such declarations or statements shall be deemed received.
  6. Every player acknowledges with the registration on GameTwist the exclusive (intellectual) property right of the operator to the General Terms and Conditions.
  7. Should any of the provisions and conditions of the contract be or become invalid the remaining parts of the contract shall remain in force and effect. This does not apply, should adherence to the contract represent an unacceptable hardship for one of the involved parties.

V. SPECIAL TERMS FOR THE GOLD SUBSCRIPTION

A. General

  1. A Standard Account can be upgraded to a Gold Subscription Account by signing up for a subscription, which is subject to a fee.
  2. When registering for a Gold Subscription Account, the user must fill in the following data fields completely, correctly and without providing any misleading information:
    1. First name and surname
    2. Home address
    3. Date of birth
  3. The operator is entitled to exclude a user from services and to refuse granting any prizes he/she may have won, should the details entered when registering be incorrect.
  4. The user undertakes to keep his/her personal data up-to-date at any time, and to correct the user data on the website forthwith by following the link “Change Data” in the event of any changes of name, address, e-mail, etc..

B. Subscription Models

  1. The 24-Hour Trial Subscription:
    Grants access to the beginner lobbies of all Gold Subscription games. Participation in tournaments and the ranking lists in the Gold Subscription area is not included.
  2. The GameTwist Gold Subscription:
    Grants unlimited access to all games, as well as participation in ranking lists and tournaments.
    Allows use of the following additional features:
    • extended user profile
    • organisation of user tournaments for the players in the personal Friends List.

C. Start, Duration and Termination of Contract

  1. GameTwist subscriptions can be ordered on the GameTwist website. The contract for the use of the subscribed services becomes effective upon payment by the user for the chosen subscription period.
  2. Upon expiry of the initial subscription period, the contract shall be extended automatically.
  3. Regular termination of the contract during a subscription period which has already been paid for is excluded.
  4. This shall not affect the right to terminate the contract for good cause. It shall be deemed good cause in particular if the user culpably infringes against the regulations contained in these General Terms and Conditions.
  5. In the case of termination for cause in accordance with Point 4, the user has no claim for any refund of the fee paid.
  6. Before the expiry of the subscription period already paid for, the user will be reminded by e-mail to pay the fee for the next subscription period.
  7. The subscription can be cancelled on the website. The subscription ends upon expiry of the subscription period already paid for.
  8. If the subscription is not cancelled and nevertheless no fee is received by the operator for the next period, the user will not be able to use the subscription features any more after the pre-paid subscription period has expired.
  9. Should payment not be made, the ranking list data of the user will be saved for 30 days. Should no payment be received during this period, the ranking data will be deleted and the subscription shall be deemed cancelled.

D. Terms of Use

  1. The user guarantees the correctness of the data entered when registering. Any individual many only be represented by one active account in the Gold Subscription area of the website.
  2. In addition to adhering to the terms of use the user undertakes to refrain from taking any measure to gain an unfair advantage in the ranking lists. In particular, collusion between participants in a game is forbidden.
  3. The user explicitly agrees to the ranking list formula as explained in the help section on the GameTwist website. The operator reserves the right to subsequently change the raking formula or the ranking system, and to change the points of the users in the ranking lists in this context. The user has no claim to points not attributed due to, for example, system errors.

E. Other Terms

  1. The operator reserves the right to change the fee for the Gold Subscription at any time. Any changes shall only become effective when the current subscription is extended. Any changes are shown on the website.
  2. The operator will make reasonable efforts to check the correctness of the ranking lists and result details shown, yet cannot guarantee in any way the complete accuracy of the data shown. The operator reserves the right to correct incorrect data and game results retrospectively, as well as to remove individual users from the ranking lists in case of violation of the terms of use.
  3. Subsidiary to the special terms in Section V, the General Terms of Sections I to IV as well as the relevant legal provisions apply.
